The Uniform Code of Military Justice defines rape as engaging in sexual
intercourse without the consent of the other party. It defines carnal
knowledge as engaging in sexual intercourse with an individual under 16
years of age. The penalties for rape can include incarceration or the
death penalty, in accordance with a decision by a court martial. Carnal
knowledge can be penalized with forfeiture of pay and allowances, 20 years
of confinement, or dishonorable discharge. If the carnal knowledge offense
involves a child under the age of 12, the penalties can be increased to
include confinement for life, without the possibility of parole.
